IRS TAX TRANSCRIPTS – Non-Borrowing Spouse

    Married couple files taxes jointly.
    Only one spouse is going to be on the loan in a state that is not a community property state.

    Would the lender be violating the spouse’s privacy when the joint tax return transcripts are pulled without the permission of the spouse that is not on the loan? What about if it was in a Community Property state?

    The 4506-T Authorization does say that a release of the returns is allowed if it is a joint return being requested, either husband or wife must sign the Authorization. It does not call for both signatures for release of the Transcripts.

    My concern is in the Privacy area. Any and all opinions are appreciated.

    You don’t have a privacy concern because you are not releasing information, you are receiving the information. Generally the 4506T comes directly or indirectly from the IRS. The privacy rules that cover your bank do not apply to a federal agency.
