Under the April 2, 2010 RESPA FAQ, the question and answer states
“Q: Is there a potential tolerance violation if the amount in Line 801 on the HUD-1 decreases from the amount disclosed in Block 1 of the GFE?”
“A: No”Does the proceeding question extend to Line 1203 when there is a decrease in transfer taxes? My thinking is yes, since it is in the same 0% tolerance category; however, could I please get some additional feedback. Thanks for your help.
If there is a decrease from what was originally stated on the GFE, then there is not a violation.
