CMG Member Glenn Vick submitted this question during our August 8, 2014 CMG meeting. Would you be allowed to ask a same sex couple for verification (copy of the marriage certificate from a state that recognizes same sex marriages) or would that be discriminatory since we normally don’t asked other married couples for proof of marriage?
ANSWER: I agree that asking some married couples for proof of their marriage, but not asking others, is discrimination. I am not sure of the basis of discrimination. The true base seems to be sexual preference, which is not a federally protected right.
