We just recently opened a new branch in a different county. Our employees at that new branch are trying to get some larger business customers. One way to try and get business is they are wanting to be able to bank those “large business customers” employees. We would run a chex systems on those employees and if their chex systems came back bad instead of denying the checking account they want to open them an account where they would just have an ATM card only. We do not do this for anyone in our other branches. Could their be a fair banking concern if we are not allowing this across the board for everyone and not just these new customers from our new location? Thank you for any input.

Yes, I do think you would have a Fair Banking issue by allowing an exception based on “large business customers” employees getting special treatment. If you were to make an exception to your Bank’s policy, you would need to make sure it was for everyone and had standards that would provide the same opportunity to all prospects equally.
